eBay Bucks Rewards Program
Program Terms & Conditions
The eBay Bucks Rewards Program ("Program") is designed to reward eBay users for purchasing items from www.ebay.com. Eligible Participants will receive Rewards based on a percentage of their Qualifying Spend and will have an opportunity to redeem Rewards in accordance with the following Terms and Conditions:
1. Eligible Participants. An Eligible Participant means an eBay user who meets the following criteria:
1.1 Is a registered member of www.eBay.com and is a legal U.S. resident, 18 years of age or older with an eBay account in good standing (no hold or suspension);
1.2 Has a valid PayPal account or successfully sign up for a PayPal account within the eBay checkout flow and such account is in good standing (no hold, suspension, or past due amount);
1.3 Was the intended recipient of a communication from eBay inviting participation in the Program ("eBay Invitation");
1.4 Successfully opts in to accept these Terms and Conditions and registers for the Program on rewards.ebay.com
1.5 Receives confirmation of registration from eBay (via confirmation page in the Program registration process); and
1.6 Has not changed his/her username listed in the applicable eBay account since April 15, 2008.
2. Qualifying Spend. Qualifying Spend means payment made for items purchased by Eligible Participants that meet the following criteria:
2.1 They were listed in U.S. dollars and purchased on www.eBay.com excluding the following categories:
2.1.1 All categories in Motors (www.motors.ebay.com) except Parts&Accessories,
2.1.2 Classifieds,
2.1.3 Live Auctions,
2.1.4 Real Estate, and
2.1.5 Business & Industrial Capital Equipment, including the following capital equipment categories and the related subcategories: Agriculture & Forestry > Tractors & Farm Machinery; Construction > Heavy Equipment, Trailers; Food Service & Retail > Concession Trailers & Carts; Healthcare, Lab & Life Science > Imaging & Aesthetics Equipment; Industrial Supply, MRO > Fork Lifts & Other Lifts; Manufacturing & Metalworking > Manufacturing Equipment; Manufacturing & Metalworking > Metalworking Equipment; Office, Printing & Shipping > Commercial Printing Presses.
2.2 Paid for using the Eligible Participant's PayPal account during the Earn Period, defined as May 14, 2008, 23:00:01 PM PDT through August 14, 2008, 22:59:59 PM PDT; and
2.3 Excludes sales tax, shipping charges, discounts, partial refunds, free items, items that fail to comply with applicable eBay terms and conditions, past purchases, and non-shipped, undeliverable or returned items.
3. Rewards. Rewards means a dollar amount in the form of a Coupon (or, in eBay's sole discretion, cash) attributed to the Eligible Participant's eBay account that meets the following criteria:
3.1 Reward amount is calculated as a percentage of Qualifying Spend (percentage as defined in eBay Invitation);
3.2 Up to $10,000 of any one item's purchase price (excluding tax and shipping fees) counts towards the total Qualifying Spend used to calculate Reward amount.
3.3 Rewards will be tied to the email account of the Eligible Participant's eBay account as of August 1, 2008;
3.4 To receive and redeem Rewards, an Eligible Participant may not change the email address associated with his/her eBay account from August 1, 2008 through September 21, 2008.
3.5 Rewards are valid and redeemable only during the Redeem Period, defined as August 21, 2008, 23:00:01 PM PDT through September 21, 2008, 22:59:59 PM PDT; and
3.6 Over the course of the Earn Period, Rewards will only be granted for up to $20,000 in aggregate Qualifying Spend for each Eligible Participant.
4. Reward Redemption. An Eligible Participant may redeem Rewards in accordance with the following requirements:
4.1 Rewards may only be redeemed toward purchases made on eBay.com, excluding purchases on www.express.ebay.com;
4.2 To use a Coupon, the Eligible Participant must pay for an item through eBay checkout using his/her PayPal account before the expiration of the Coupon;
4.3 A Coupon only applies for a one-time use towards the total purchase price (which is equal to the sum of item prices, shipping and handling, tax, and insurance) of a single transaction from a single seller using a single method of shipping and single currency;
4.4 Rewards will be deducted from the total purchase price and any unused difference between the total purchase price and Reward amount will be forfeited;
4.5 Rewards must be redeemed by the Eligible Participant during the Redeem Period (August 21, 2008, 23:00:01 PM PDT - September 21, 2008, 22:59:59 PM PDT) and shall be forfeited if not redeemed by the Eligible Participant during the Redeem Period;
4.6 Rewards are not transferable and has no face value;
4.7 Rewards cannot be redeemed through some customized checkout systems;
4.8 Rewards cannot be used retroactively for prior purchases; and
4.9 Rewards cannot be redeemed for cash but eBay reserves the right to give Rewards in the form of cash in its sole discretion.
5. Other Terms and Conditions.
5.1 Restrictions. The Program is void where prohibited and subject to U.S. laws. eBay reserves the right to modify or terminate this Program at any time without prior notice. The Program will expire at 22:59:59 PM PDT on September 21, 2008.
5.2 No Combination with Other Programs. The Rewards cannot be combined with any other coupon in one purchase. Rewards may be combined with Gift Certificates and Gift Cards.
5.3 Limitation of Liability. EBAY AND PAYPAL SHALL NOT BE LIABLE FOR ANY CLAIMS, ACTIONS, INJURY, LOSS OR DAMAGE OF ANY KIND, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY OR DEATH, RESULTING FROM THE PROGRAM. THIS LIMITATION OF LIABILITY IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING (WITHOUT LIMITATION) COMPENSATORY, DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, INCOME, OR PROFIT; LOSS OR DAMAGE TO PROPERTY; AND CLAIMS OF THIRD PARTIES. RECIPIENTS OF THE PROGRAM AGREE THAT EBAY AND PAYPAL HAVE NOT MADE NOR ARE IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, STATUTORY, EXPRESS OR IMPLIED (INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, AND FITNESS FOR A PARTICULAR PURPOSE), IN FACT OR IN LAW, RELATIVE TO THE PROGRAM. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, EBAY AND PAYPAL DO NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS WITH RESPECT TO WWW.EBAY.COM OR WWW.PAYPAL.COM AND EBAY AND PAYPAL SHALL NOT BE LIABLE FOR THE CONSEQUENCES OF ANY INTERRUPTIONS OR ERRORS RELATED THERETO. THESE TERMS GIVE YOU SPECIFIC LEGAL RIGHTS. eBay and PayPal are not responsible for printing or typographical errors in any Program related materials; for stolen, lost, late, misdirected items; or for transactions and/or emails that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, human or other error; or for electronic, computer, or telephonic malfunction or error, including inability to access any web site associated with the Program, or process any transaction thereon. If in eBay's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Program, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Program, eBay reserves the right at its sole discretion to disqualify any individual connected therewith, to modify or suspend the Program, or to terminate the Program. In all matters relating to the interpretation and application of any rule or phase of this Program, the decision of eBay shall be final. eBay reserves the right to cancel, amend or revoke any Program at any time due to reasonable business consideration or circumstances beyond its control. Any attempt by an Eligible Participant or any other individual to deliberately damage any web site or undermine the legitimate operation of the Program is a violation of criminal and civil laws and should such an attempt be made, eBay reserves the right to revoke any Rewards and seek damages and other remedies from any such person to the fullest extent permitted by law. Any attempts by an individual to access any web site associated with the Program via a bot script or other brute force attack or any other unauthorized means will result in the IP address becoming ineligible. Use of automated devices or programs to redeem the Program is prohibited.
5.4 Governing Law. These Terms and Conditions will be interpreted, construed and enforced, and governed in all aspects in accordance with the exclusive jurisdiction and laws of the state of California. Any cause of action arising under or relating to these Terms and Conditions will be brought exclusively in a court in Santa Clara County, CA.
